Official Rules / 2021
NO PURCHASE NECESSARY TO ENTER OR WIN THE CONTEST. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
These Official Rules (the “Rules”) apply to the Fairfield County’s Giving Day “Why I Give” Video Contest (the “Contest”), sponsored by Fairfield County’s Community Foundation, 40 Richards Avenue, Norwalk, CT 06854 (“Sponsor”), and conducted via the Facebook social media platform.
BY ENTERING THE CONTEST, YOU AGREE TO BE BOUND BY THE RULES AND YOU CERTIFY THAT YOU ARE AN ELIGIBLE PARTICIPANT, AS DEFINED BELOW.
The Contest is in no way sponsored, endorsed, administered by, or associated with Facebook or any other third-party, including without limitation the nonprofits listed on fcgives.org.
ELIGIBLE PARTICIPANTS. The Contest is open to legal residents of the 50 United States of America plus the District of Columbia and Puerto Rico, age 13 or older, as of the date of entry. The Contest is not open to employees, officers, board members, or other representatives of Sponsor or of Sponsor’s subsidiaries or affiliates. Members of the immediate families or households of the foregoing individuals are also ineligible to participate in the Contest. Entrants under the age of 18 are required to have their parent’s or guardian’s permission before entering the Contest.
CONTEST PERIOD. The Contest begins on Monday, January 25, 2021 at 12:00:00am ET and ends at 11:59:59pm ET on Monday, February 15, 2021 (“Contest Period”). Sponsor’s clock, located on the FCGives.org website, is the official clock of the Contest.
HOW TO ENTER & WIN.
- Create a short video, no longer than 60-seconds in length, that explains why you give your heart, time, money, expertise and/or other form of giving to ONE, SPECIFIC local 501(c)3 nonprofit organization providing services to residents of Fairfield County, Connecticut, and registered in Fairfield County’s Giving Day 2021. All of the nonprofits meeting the foregoing requirements and eligible to receive a prize in this Contest are listed at fcgives.org.
- Post the video on your personal Facebook page during the Contest Period. Your Facebook post must be set to “public” for your video entry to be eligible. In the text post that accompanies your video you must include all of the following:
- the hashtag: #WhyIGive21
- A “tag” of the local 501(c)3 featured in the video (tag their Facebook page)
- A “tag” of Fairfield County’s Community Foundation’s Facebook page (it is this tag = @FCCFoundation)
- Encourage your Facebook fans and followers to “Like” your video.
- Eligible video entries with the most “Likes” on the Facebook page where the video was originally posted will be deemed the winning videos. The nonprofit named in the eligible video with the most “Likes” will be the recipient of a $1,000 grant prize. The named nonprofits in the eligible videos with the second, third, and fourth most “Likes” will each be the recipient of a $500 grant prize.
NOTE: In order to receive the prize, both the winning Eligible Participants and the winning Eligible Participants’ named nonprofits will be required to provide a writing to Sponsor (in a form approved by Sponsor) acknowledging and agreeing that they are legally bound by these Rules. Sponsor shall be under no obligation whatsoever to award the prize to the Eligible Participants’ nonprofits unless the foregoing writings are provided, and in the event that the Eligible Participants or his/her winning nonprofits are unable or unwilling to provide such a writing, Sponsor may, in its sole discretion, select a different winning Eligible Participant based on the criteria set forth in these Rules.
Video submissions MUST:
- Be focused on ONE, SPECIFIC local 501(c)3 nonprofit organization participating in Fairfield County’s Giving Day 2021. For a list of registered nonprofits visit FCGives.org. If your nonprofit is not listed as registered on fcgives.org, it is not eligible to receive a prize in this Contest. Please note that you can prepare more than one video for the Contest during the Contest Period, however, as stated above, each video must relate to only one eligible nonprofit.
- Fairfield County, Connecticut is comprised of these 23 towns and cities: Bethel, Bridgeport, Brookfield, Danbury, Darien, Easton, Fairfield, Greenwich, Monroe, New Canaan, New Fairfield, Newtown, Norwalk, Shelton, Sherman, Stamford, Stratford, Redding, Ridgefield, Trumbull, Weston, Westport, and Wilton.
- Be no longer than 60-seconds in length
- Be PG-rated and family-friendly: no cursing or other language that could be considered offensive may be used in the video
- Be in English or Spanish
- Not contain music, sound(s), image(s), or material(s) that are protected by or in any way subject to the intellectual property rights of third parties, or that otherwise require any consents or approvals from a third party(ies) for the Sponsor to use or post on public websites, social media, or to use in public forums of any kind. If you have any doubt, please leave it out of your video submission.
Video submissions MUST NOT:
- Be promoted with paid advertising to increase visibility
- Purchase social media engagement
- Not contain music, sound(s), image(s), or material(s) that are protected by or in any way subject to the intellectual property rights of third parties, or that otherwise require any consents or approvals from a third party(ies) for the Sponsor to use or post on public websites, social media, or to use in public forums of any kind. If you have any doubt, please leave it out of your video submission.
ODDS. The odds of winning depend on the number of eligible entries submitted during the Contest Period.
NOTIFICATIONS:
Prior to the public announcement of the winning video on February 25, 2021. The following will be notified:
TO EACH OF THE INDIVIDUALS WHO SUBMITTED WINNING VIDEOS:
The notification shall be delivered via a Facebook message that the nonprofit they named will be the recipient of the (1) $1,000 grant prize or one of the (3) $500 grant prizes.
TO THE NAMED NONPROFIT IN THE WINNING VIDEO:
An email will be sent to the named nonprofit to advise that they will be in receipt of the (1) $1,000 grant prize, or one of the (3) $500 grant prizes.
PRIZE:
One Grand Prize, based on the eligible video receiving the most “Likes” on Facebook, will be awarded consisting of a $1,000 grant from Sponsor to the nonprofit organization featured in the video of the winning entry. The Grand Prize grant amount shall be provided by Sponsor to the winning nonprofit within [4 weeks] of the conclusion of the Contest Period, or as soon as is reasonably practicable thereafter.
Three Runners Up Prizes, based on the eligible videos receiving the second, third, and fourth most “Likes” on Facebook, will be awarded consisting each of a $500 grant from Sponsor to the nonprofit organization featured in the videos of the winning entries. The Runners Up Prizes grant amounts shall be provided by Sponsor to the winning nonprofit within [4 weeks] of the conclusion of the Contest Period, or as soon as is reasonably practicable thereafter.
All decisions of Sponsor regarding winners selections and awarding of the Prizes are final. The Prizes are not transferable or refundable, and must be accepted as awarded. No alternatives to the Prizes will be made available. Any federal, state and local taxes or other fees associated with winning the Prizes are solely the responsibility of the winning Eligible Participants and winning nonprofits. Sponsors reserve the right to substitute the Prizes with a prize of comparable or greater value, in its sole discretion and without prior notice.
The winning entries and names of the nonprofit organization receiving the 2021 grants will be announced publicly on Fairfield County’s Giving Day 2021, February 25, 2021. The grant amounts will not be included in the nonprofits’ Giving Day totals or impact their position on the leaderboard.
GENERAL CONDITIONS OF PARTICIPATION. The Sponsor is not responsible for incomplete, lost, late, delayed or garbled registrations or entries or incorrect or inaccurate capture of entry information, including but not limited to technical malfunctions, human or technical error, omission, interruption, deletion, defect, or failures of any telecommunications device(s) or system(s) of any kind. Sponsor reserves the right in its sole discretion to terminate or modify the Contest in any way, for any reason, and without prior notice. Sponsors also reserve the right, in its sole discretion, to disqualify any Contest participant it finds to be tampering with the entry process or the operation of the Contest, to be acting in violation of these Rules, or to be acting in an unsportsmanlike or disruptive manner. The use of automated devices, programs, or methods to submit entries or increase an entry’s chances of winning is prohibited and the Sponsor reserve the right, in its sole discretion, to disqualify any entry that it believes may have been submitted using such an automated device, program or method.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE CONTEST OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
The Eligible Participant represents that his/her video submission was taken with the permission of the subject(s) (or, where the submission shows any underage persons, the consent of their parent or guardian) and/or venue, location, photo, and sound owner and does not infringe on the copyright or other intellectual property right of any third party. The Eligible Participant further guarantees that they own the copyright for the submissions and for the usage rights required by the Contest.
Sponsor’s failure to enforce any of the Rules shall not constitute a waiver of such Rule or any of the other Rules. Entry into this Contest shall constitute entrants’ agreement to release and hold harmless the Sponsor, its affiliates and subsidiaries, and each of the foregoing’s officers, directors, board members, employees, and agents from any and all liability arising from or associated with participation in the Contest, including but not limited to any harm, damages, costs or expenses associated in any way with the acceptance, possession, use or misuse of any of the Prizes, or occurring while preparing for, participating in and/or traveling to or from any Contest-related activity.
LIMITATION OF LIABILITY; INDEMNIFICATION. Sponsor, and all other companies involved in the development or operation of the Contest or the provision of the prizes, the successors and assigns of each of the foregoing, the social networks, and the officers, directors, employees and agents of each of the foregoing (collectively, the “Released Parties”) are not responsible for, and will have no liability to, any entrant or any other person or entity for any claims, whether at law or in equity, that entrant or any other person or entity has had or shall have at any time (whether or not entrant is/was aware of any such claims) relating to the Contest, entrant’s preparation and/or submission of a video for or in the Contest, or any other matter related to the Contest and/or the Sponsor, including without limitation: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries.
The Eligible Participants agree to indemnify, hold and save harmless and defend at his/her own expense, Sponsor, its affiliates and subsidiaries, and all of the foregoing entities’ employees, officers, board members, and agents, from and against any claims, suits, damages, liabilities, and demands made by any third parties in respect of the Eligible Participants’ creation and/or submission of the video for or in the Contest, his/her participation in the Contest, or any other matter related to the Contest and/or the Sponsor.
PUBLICITY RELEASE. Except where prohibited by law, submission of a Contest entry shall constitute the Eligible Participant’s agreement that the Sponsor may use their name, voice, likeness, biographical information, appearance, performance, video and Prize for promotional and/or commercial purposes without further notification or compensation. Each entrant agrees to execute any additional documents which Sponsor may from time to time submit to them to evidence, establish, maintain, protect, enforce or defend Sponsor’s exercise and full exploitation of any of the rights entrant has granted to Sponsor herein.
DISPUTES. Entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Fairfield County, Connecticut, U.S.A.; (b) any and all claims, judgments, and awards shall be limited to actual damages; and (c) under no circumstances will the participant be permitted to obtain awards for, and entrants hereby waive any rights to, any type of special damages, including but not limited to punitive, incidental, or consequential damages. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules, or Sponsor’s and/or entrant’s rights and obligations thereunder, as well as any disputes or claims arising from or associated with the Contest, shall be governed by and construed in accordance with the laws of the State of Connecticut but without regard to any choice of law or conflict of law rules.
WINNERS LIST. obtain the name of the winning video and nonprofit, send a self-addressed, stamped envelope to: “Why I Give” Contest Winners List, c/o Fairfield County’s Community Foundation, 40 Richards Avenue, Norwalk, CT 06854. All requests for winners list must be received by March 31, 2021.
*Sponsor reserves the right to change, update or otherwise amend these rules and guidelines at any time.
